Self-Assessment Tool for Mortgage Sector

This tool helps individuals and firms in the mortgage industry determine if requirements of the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (the Act) and associated Regulations apply to them as of October 11, 2024.

The Regulations define the services and activities of mortgage administrators, mortgage brokers and mortgage lenders. As an individual or a firm performing these services or activities, your business may be subject to the Act and Regulations.

The mortgage sector is comprised of:

Mortgage administrators

A mortgage administrator is a person or entity, other than a financial entity, that is engaged in the business of servicing mortgage agreements on real property or hypothec agreements on immovables on behalf of lenders.

Mortgage brokers

A mortgage broker is a person or entity that is authorized under provincial legislation to act as an intermediary between a lender and a borrower with respect to loans secured by mortgages on real property or hypothecs on immovables. 

Mortgage lenders

A mortgage lender is a person or entity, other than a financial entity, engaged in the business of providing loans secured by mortgages on real property or hypothecs on immovables.

Determining your obligations under the Act

Individuals who work exclusively for or on behalf of a mortgage administrator, a mortgage brokerage firm, or a mortgage lender as an agent or a mandatory do not need to complete a self-assessment, as it is those firms or legal entities who will be responsible for implementing a compliance program and complying with other requirements under the Act and associated Regulations.
